Terms & Conditions

By creating an account, accessing, or using the Sculpt platform at www.mysculptapp.com (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Sculpt, operated by Aion Sculpts (“Company,” “we,” “us,” or “our”).

These Terms also apply to our marketing website at www.aionsculpts.com, including the free calculators and planners offered there. Those tools are provided without an account, free of charge, and are subject to the same disclaimers and limitations set out in these Terms — including the Health & Fitness Disclaimer in Section 2. Results they produce are general estimates, not coaching or medical advice.

One of those free offerings is the free plan kit. To build it we ask for your name and email address before it is generated, along with the intake described in our Privacy Policy. The kit is offered once per person; if you request another we will send you the one we already built for you. We may decline, withdraw, or change the offer at any time, and we may refuse it where we reasonably believe it is being requested automatically or in bad faith. The kit is AI-generated, general, and is not coaching or medical advice — Sections 2 and 6 apply to it in full.

Sculpt is operationally and legally separate from any other businesses owned by Aion Sculpts. Use of the Sculpt platform does not create any relationship between you and any non-Sculpt entity operated by Aion Sculpts.

The fitness programs, nutrition plans, coaching content, and AI-generated recommendations provided through Sculpt are for informational and educational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

By using the Service, you acknowledge and agree that:

• You should consult a licensed physician or healthcare provider before beginning any new exercise or nutrition program, particularly if you have a pre-existing medical condition, injury, or are pregnant
• You participate in all fitness activities at your own risk
• Sculpt and its coaches are not licensed medical professionals and do not provide medical advice
• Results from fitness and nutrition programs vary by individual and are not guaranteed
• You are solely responsible for monitoring your physical response to any exercise or dietary change and ceasing activity if you experience pain, discomfort, or adverse symptoms

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are under 18, you may not use the Service.

To access the Service, you must create an account by providing accurate and complete information. You must also affirmatively accept these Terms and our Privacy Policy at the time of registration. We record the date and time of your acceptance.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account at help@aionsculpts.com

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

5.1 Subscription Plans

Sculpt offers several subscription tiers with different features and pricing. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis at the rate disclosed at the time of purchase.

5.2 Billing Cycle

Subscriptions are billed monthly. Your billing cycle begins on the date you subscribe and renews on the same date each month.

5.3 Cancellation Policy

You may cancel your subscription at any time through your Account settings. Cancellations take effect at the end of your current billing period. You will retain full access to the Service until that date. We do not provide refunds for partial billing periods.

5.4 Price Changes

We reserve the right to change subscription pricing with at least 30 days’ advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5.5 Payment Processing

Payments are processed by Stripe. By providing payment information, you agree to Stripe’s terms of service. We do not store your full payment card information.

5.6 AION Usage Allotments and Add-Ons

Paid subscriptions that include AION AI coaching provide a monthly allotment of AION coaching interactions (“turns”), in the amount disclosed at the time of purchase and shown in your Account settings. Unless otherwise stated, your included monthly allotment resets at the start of each billing cycle and does not carry over to the next cycle. Some plans are not subject to a monthly turn allotment; whether your plan includes an allotment, and its size, is indicated at the time of purchase and in your Account settings.

If you reach your monthly allotment, you may continue by purchasing additional turns (“add-on packs”) at the prices disclosed at the time of purchase. Purchased add-on turns carry over between billing cycles for as long as your subscription remains active, and are used only after your included monthly allotment is exhausted. Add-on purchases are one-time charges and are non-refundable except where required by law.

Business or organization plans may provide a shared pool of turns allocated across the organization’s members and administered by the organization’s designated administrator.

We may introduce, change, or discontinue usage allotments or add-on pricing. For existing subscribers, we will provide at least 30 days’ advance notice of any change that reduces your included allotment or increases the price you pay, by posting the updated Terms on this page and, where appropriate, by email. Your continued use of the Service after the change takes effect constitutes acceptance of the change.

5.7 Service Issues, Malfunction Notification, and Chargebacks

If you believe the Service is not functioning as described — including any error, outage, bug, or other malfunction — you agree to notify us promptly at help@aionsculpts.com and to give us a reasonable opportunity to investigate and resolve the issue before pursuing any refund, dispute, or payment reversal. Our support records and system logs are the authoritative record of whether an issue was reported and whether the Service was available to your account.

You acknowledge that initiating a chargeback or payment dispute with your bank or card issuer, instead of contacting us first, prevents us from addressing your concern. By subscribing, you agree that:

• You are responsible for notifying us of any claimed malfunction before disputing a charge;
• Failure to notify us and allow a reasonable opportunity to cure constitutes a waiver of any claim that the Service did not function, and forfeits any chargeback or payment dispute brought on that basis; and
• We may submit these Terms, your acceptance record, your account activity, and our system logs to your bank, card issuer, or payment processor as evidence in response to any dispute.

Chargebacks filed without first contacting us, or filed in a manner inconsistent with our records showing the Service was delivered and operational, may be contested and may result in suspension or termination of your account. Nothing in this section limits any right you have that cannot be waived under applicable law.

Sculpt uses artificial intelligence (referred to in the platform as “AION”) to generate personalized workout plans, meal plans, motivational content, and conversational coaching responses. You acknowledge that:

• AI-generated plans are based on the information you provide and are not reviewed by a licensed medical professional before delivery
• AI recommendations may not account for all individual health factors
• You are responsible for exercising personal judgment before following any AI-generated recommendation
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content for your specific circumstances
• Photos, videos, and PDF documents you send to AION are transmitted to our AI service provider (Anthropic) solely for the purpose of generating a coaching response, and are not retained by Anthropic beyond that request
• Output from the free tools and the free plan kit on our marketing website is AI-generated on the same basis — built from what you told us, unreviewed by a medical professional, and general rather than individualized care

Certain subscription tiers include access to a human fitness coach. Coach services are provided by independent fitness professionals. Coaches are not employees of Sculpt. Coaching advice is fitness-oriented and does not constitute medical, psychological, or nutritional therapy.

Response times from coaches may vary. We do not guarantee specific response times for coaching tiers.

You agree not to:

• Use the Service for any unlawful purpose
• Share your account credentials with others
• Reverse engineer, copy, or redistribute any portion of the platform
• Upload or share content that is harmful, offensive, or infringes on the rights of others
• Upload images, videos, or documents that depict illegal activity, sexually explicit content, or content involving minors
• Use the Service to harass, abuse, or harm another person
• Attempt to gain unauthorized access to any part of the Service

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, AI-generated plans, workout methodologies, training frameworks, and software — are the property of Sculpt, Aion Sculpts, or their licensors, and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. You may not reproduce, distribute, or create derivative works from any content on the Service without our express written permission.

You retain ownership of any photos, videos, or documents you upload through the Service. By uploading content, you grant Sculpt a limited license to store and process that content solely for the purpose of providing the Service to you.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

By providing your phone number during registration and opting in, you consent to receive SMS messages from Sculpt. SMS messages are delivered through Twilio. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP. For help, reply HELP. Opting out of SMS will not affect your access to the Service.

By providing your email address — during registration, or when you submit it through one of the free tools on www.aionsculpts.com — and opting in to marketing, you consent to receive marketing email from Sculpt, including training and nutrition content, product news, and promotional offers. Every marketing email includes an unsubscribe link, and you may withdraw consent at any time using that link or by contacting us at help@aionsculpts.com. Opting out of marketing email does not affect transactional email about your account, and does not affect your access to the Service. Our handling of your email address is described in our Privacy Policy.

To the maximum extent permitted by applicable law, Sculpt, Aion Sculpts, their owners, employees, coaches, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, loss of data, loss of revenue, or any other damages arising from your use of the Service or participation in any fitness program.

Our total liability to you for any claims arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Sculpt, Aion Sculpts, and their affiliates, officers, coaches, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service.

You may terminate your account at any time by contacting us at help@aionsculpts.com. Cancellation of a paid subscription does not delete your account; access remains active through the end of your billing period.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and, where appropriate, by email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.
